This Terms of Sale document is an electronic record under the Information Technology Act, 2000. It does not require any physical or digital signatures and is legally binding between the Buyer and Vendor.
"Vendor" refers to Refresh Mattress; "Buyer" refers to a User purchasing products via the Website.
By listing products on the Website, the Vendor offers them for sale, and upon acceptance by the Buyer, this forms a binding agreement.
These Terms must be read in conjunction with the Website's Terms of Use, Privacy Policy, and all other applicable policies.
These Terms may be updated at any time. Continued use of the Website constitutes acceptance of such changes.
The contract for the sale of a product is created once the Buyer places an order and the Vendor confirms it. The Vendor may cancel the offer at any time before delivery.
Acceptance is deemed complete once payment is processed and the Buyer receives an order confirmation.
The Vendor reserves the right to cancel orders due to unavailability, pricing errors, or technical issues, even after confirmation. A full refund will be issued where applicable.
The Buyer acknowledges that placing an order indicates an intent to purchase and creates a binding obligation, subject to Vendor confirmation.
Any modification or cancellation after confirmation is at the Vendor's discretion.
Product availability may vary depending on inventory, demand, and delivery location.
Buyers must provide accurate shipping and contact details. Any errors may result in cancellation or delay.
In cases of suspected fraud or misuse, the Vendor may cancel orders and restrict future transactions.
Products are sold per their listed description, specifications, and warranty terms, if any.
All payments must be made online unless alternate methods are specified.
Stock availability is shown as “In Stock” or “Out of Stock,” but may change post-order due to simultaneous orders.
If an order is canceled within 24 hours and payment is made, a refund will be processed as per policy.
The Vendor warrants that:
Products are free of encumbrances.
Products meet described specifications.
Buyer will have peaceful possession and full warranty rights.
Prices are shown as provided by the Vendor and may change without notice.
Prices are inclusive of all applicable taxes, unless stated otherwise.
Vendor is responsible for packaging and dispatch. Risk of damage/loss during transit lies with the Vendor.
Delivery is free unless mentioned otherwise.
Orders are typically dispatched within 2–3 working days and delivered within 6–9 working days, depending on location.
Delivery timelines are indicative. Payment is required for proceeding the order.
Buyer must ensure someone is available to receive the product. Re-delivery may incur charges.
Title and risk transfer to the Buyer upon delivery and full payment.

Refunds for cancelled orders are processed within 7–10 working days.
These Terms do not alter any separate agreements related to product warranties or services.
Vendor is not liable for issues caused by third-party delivery services post-dispatch.
Warranties and after-sales service are as per the Vendor’s individual policy.
Force Majeure: Vendor shall not be liable for delays due to natural disasters, pandemics, war, or other events beyond its control.
Severability: If any term is held invalid, the rest shall remain in force.
Privacy: Buyer’s personal data will be used per the Privacy Policy.
Communication: Buyer consents to receive updates via email, SMS, or phone.
Governing Law: These terms are governed by Indian law. All disputes are subject to the courts of Delhi, India.
The platform provides an online interface for users to buy smart sleep products.
By registering, Buyers consent to receive transactional emails, calls, and messages, even if they are registered under DND.
Buyers may opt out of communications at any time.
Refresh Mattress may verify Buyer information for service delivery.
Buyer indemnifies Refresh Mattress from any losses arising from misuse or breach of terms.
